OSHA ETS UPDATE

This morning (November 23, 2021), the U.S. Department of Justice requested that the 6th Circuit Court of Appeals lift the stay preventing OSHA from enforcing the OSHA COVID-19 Vaccination ETS. At this time, the 6th Circuit has not issued a ruling on the request by the federal government. If lifted, employers would be required to adhere to the provisions of the ETS. As a reminder, the requirements of the ETS would go into effect on December 5, 2021, if lifted. Employers with 100 or more employees should be prepared to comply with the requirements of the ETS in the event the court eventually permit its implementation and enforcement.
