HERE IT COMES...

Nope, even thought it is getting close to Halloween, the “It” we’re referring to is not Pennywise, but the OSHA ETS which will require employers with over 100 employees to either require employees to be vaccinated for COVID-19 or undergo weekly testing. OSHA has now submitted the proposed rule to the White House for review. This means that the standard will be implemented shortly and employers must be prepared.

It is recommended that if you are an employer with over 100 employees, you should require employees to disclose their vaccination status to determine how this may impact your workforce and assist you on making a decision on the “vaccination vs. testing” conundrum you are likely to be presented with.

While there may be court challenges to the standard once it is implemented, employers should prepare as if they will be bound by its requirements. If you have any questions on this or any other labor and employment matter, please do not hesitate to contact any of the attorneys at Hoffman & Hlavac.
